Legislation and regulations

The WorkCover Scheme operates under the Workers Rehabilitation and Compensation Act 1986. This Act sets up the structure of the Scheme, and in particular spells out how basic elements of the Scheme work, such as worker entitlements, rehabilitation and return to work, claims management, employer levies and dispute resolution.

There are a number of regulations that operate under the above Act. These mainly expand on parts of the Act in more detail.

WorkCoverSA itself is set up under the WorkCover Corporation Act 1994. This Act sets out WorkCovers objectives, powers, duties, functions, status and interaction with other bodies. There are two sets of regulations under this Act.

The Government has now approved a replacement set of regulations under the Workers Rehabilitation and Compensation Act 1986.

The new Workers Rehabilitation and Compensation Regulations 2010 will commence on 1 November 2010. WorkCover’s current regulations will continue to apply until this time.
